What is eminent domain?

Eminent domain is the process by which the government can take private property for public use. The government must pay just compensation for the portion of property that is taken, and it must show that the taking is necessary for public use.

Eminent domain takings can often be challenged on the grounds that all of the property being taken is not needed for public use, that the project in question should not be defined as public use, or -- most commonly -- that the compensation offered does not reflect the true value of the property.
